Pension poaching refers to a financial scam that targets Veterans, survivors and family members who may be eligible for VA pension benefits. Unfortunately, it is a common scheme for scammers looking to take advantage of VA pension benefits. It is important for all Veterans and their families to recognize the warning signs of pension poaching and know how to seek proper guidance when applying for VA benefits and services.

VA resources

VA-recognized and accredited claims agents, attorneys and Veterans Service Organization (VSO) representatives can assist Veterans and survivors with filing a claim for VA benefits. They are not allowed to charge claimants a fee for their services unless the Veteran or survivor requires help to re-file a claim after VA has issued its decision. The VA-recognized agent or attorney must also file a fee agreement with VA before you’re charged any fees.

One of the most common pension poaching schemes is when a scammer falsely impersonates an attorney or financial claims advisor to force the claimant to pay a fee for their services. Remember, Veterans or survivors who are not re-submitting a claim that has already been issued a decision are not required to pay any fees. Therefore, always request proof of an official VA fee agreement when you are asked to pay for claimant services.
